Mostly. There are works, which were created before copyright laws. The plays and sonnets of Shakespeare or the poems of Homer would be examples of public domain intellectual property. Shakespeare lived in the 1500's. Homer (according to Herodotus) was born somewhere around 850 BC.
Even so, there are editions and translations of both these artists that are covered by copyright laws due to the manipulations of the text performed by publishers. The pornographic frescoes recently unearthed in Pompeii belong to the world but don't kid yourself. You probably can't reprint any images of them -for commercial purposes- without paying royalty fees. Those Pompeiian porno shots belong to their photographers.
A fella where I lived had a little run-in with Intellectual property of the most personal kind. He tried to buy the rights to the name Thomas A. Edison. Actually, he did buy the rights but has since had buckets of trouble using the name for his computer manufacturing company. He was as amazed as everyone was when he discovered the name had not been copyrighted. He jumped on the opportunity and took all the legal steps to purchase. Now he's tied up in litigation and restraining orders and his dreams of a new PC for the masses are in limbo.

A fool because it's a good as theft. A fool because there's so much free content to be had from allowable resources. So you're poor. So you're not a graphics master. So what if others do it? Too many providers, sponsors and sites offer free content to adult webmasters for your situation to become an excuse to be a criminal.
If you don't know already you know now that adult sponsors give free content to their affiliate webmasters. As long as you abide by their terms of use, you can exploit a source of content that directly advertises the program or service you're selling. Salesmen in the real word have to pay for their sample kits and products. They manage to make their income from using the tools you get for nothing. Free sponsor content may have a short shelve life but a heck of a lot of webmasters make mucho diñero using their freebies. If free sponsor content won't work for you then maybe you should look to other alternatives for gratis adult imagery.
You can always try some of the many content providers who let webmasters use their products in trade for links/traffic. There are plenty of sources that will let you use their images, feeds and templates provided you obey their conditions.
Some adult webmaster build entire free sites using only gratis content. There are several paysites, which use complimentary porn feeds inside their member's area. Sometimes adult webmaster resource sites will give free content to their subscribers. Moreover, most adult webmaster resource sites have sections devoted to listing/linking free content providers. It might get overused soon after it's released. You will probably lose some customers to the embedded ads within it. But if you can't afford to buy site meat, permission-based free content is honest, useful and usually high quality.
As it is wrong to 'borrow' adult content, it's just as wrong to go snatching graphic creations to decorate your page. Buttons, bars and backgrounds abound on the Internet. If you're graphically challenged or just need some stock photos, you don't have to steal. If you've got a collection of vintage porn dating back to the nineteen twenties then maybe -just maybe- you've got some public domain porn. Then again you might not. If you troll the newsgroups and grab images, then you're probably stealing. Don't do it. It's not worth it. Be wary of anyone who claims they have public domain content. They're doubtless blowing smoke up your butt.
